Inspection of the item and visible defects

Article 403.

(1) The buyer is obliged to inspect the received item in the usual manner or have it inspected, as soon as possible in the normal course of things, and to notify the seller of any visible defects within eight days, and in the case of a commercial contract without delay, otherwise he loses the right he is entitled to on that basis.

(2) When the inspection is carried out in the presence of both parties, the buyer is obliged to notify the seller of his objections to any visible defects immediately, otherwise he loses the right he is entitled to on that basis.

(3) If the buyer has shipped the item further without reloading, and the seller was or should have been aware of the possibility of such further shipment when concluding the contract, the inspection of the item may be postponed until it arrives at the new destination, in which case the buyer is obliged to inform the seller of the defects as soon as he could have learned about them from his clients in the normal course of things.

(4) In consumer contracts, the consumer as the buyer is not obliged to inspect the item or have it inspected, but is obliged to inform the seller of the existence of visible defects within two months from the day on which he discovered the defect.

In the event of a justified complaint, the contract may be terminated with a refund of the amount paid or a replacement of the product. In the event of damage and/or defectiveness of the delivered goods, the Buyer may return the item to the specified address in order for the complaint to be accepted on the basis of physical evidence. If a careful inspection determines that the product was damaged by intentional/accidental mechanical action, which occurred after the product was inspected and sent to the Buyer, the complaint will be rejected or disputed. In this case, the Buyer’s material liability for the purchased product will be determined.

Complaints must be properly packaged. All complaints that are improperly packaged or that are visibly mechanically damaged in transport will not be accepted, but will be returned to the sender at his expense.

Keep the purchase or delivery receipt in case of a product complaint.
